CPS PRIVACY POLICY

Welcome to CPS’s Privacy Policy!
TL;DR: We collect the personal information reasonably needed to run a parking-space booking and reservation platform which includes but does not limit to names, contact details, addresses, and payment information (processed for us by Stripe), whether you use CPS as a Garage Operator (defined under Preamble Clause 2 below) or as a User/Driver (defined under Preamble Clause 2 below) making a reservation. This Privacy Policy applies to all Garage Operators and Users. It is organized into three parts: Part A (for Garage Operators), Part B (for Users/Drivers), and Part C (general provisions applicable to both Garage Operator and Users/drivers). Please read the part(s) relevant to you carefully.
PREAMBLE
- This CPS Privacy Policy (the “Privacy Policy”) is issued by Creative Parking Solutions LLC, a Connecticut limited liability company with a principal place of business at 2093 Philadelphia Pike (#3407) Claymont, DE 19703 (the “Company”, “CPS”, “we”, “our”, or “us”), for individuals who interact with the website https://www.creativeparkingsolutions.com/ (the “Website”) and the CPS mobile application/portal (the “App”), whether as a Garage Operator or as a User/driver.
- CPS provides an online parking reservation and booking platform (the “Service”) that connects businesses or individuals who list available parking spaces on the Service (“Garage Operator”, “you”, or “your”, as applicable in this Part) with individuals who search for, book, and pay for parking spaces in advance through the Service (“User”, “Driver”, “you”, or “your”, as applicable in this Part) for advance bookings of parking spaces (“Advance Reservations”).
- This Privacy Policy does not currently cover any physical vehicle-tracking or sensor hardware, as such hardware is not a part of the Service today.
- By registering for, accessing, or using the Website or App, you agree to the collection and use of information as described in this Privacy Policy.
PART A: GARAGE OPERATORS
A-1 Information We Collect from Garage Operators
TL;DR: We collect your contact, business, payout, and login details, plus standard usage data; the categories we need to run the Service for you.
- Contact and identity information which includes but is not limited to name, phone number, email address, and business address (and, where applicable, a home address for sole proprietors or individual garage owners).
- Business information which includes but is not limited to garage/business name, garage location(s), operating hours, number and type of available parking spaces, and pricing.
- Payout information which includes but is not limited to bank account or payout details needed to receive payments collected from Users, which are collected and processed through our third-party payment processor, Stripe.
- Account credentials which includes but is not limited to a username and password (or equivalent login credentials) used to access the CPS portal.
- Usage Data and Cookies, as described in Part C of this Privacy Policy.
- We collect the categories of information described in this Section A-1 to provide the Service to you effectively. Further detail on how each category of information is used is set out in Section A.2 (How We Use Garage Operator Information) below.
A-2 How We Use Garage Operator Information
TL;DR: We use your information to run your account and listing, process and remit your payments, communicate with you, give you transaction records, meet legal/tax obligations and improve the Service.
- To create and administer your CPS account and list your garage on the App: using your contact and identity information, business information, and account credentials.
- To process and remit payments collected from Users in connection with confirmed Advance Reservations at your garage, in accordance with the payment-processing terms of your Trial or services agreement with us: using your payout information (bank account/payout details).
- To communicate with you about your account, bookings, platform updates, or support requests: using your contact and identity information.
- To provide you with transaction records and reporting so you can reconcile bookings and payments: using your business information and payout information.
- To comply with legal, tax, and accounting obligations: using your contact and identity information, business information, and payout information.
- To improve and analyze the Service: using Usage Data and Cookies.
A-3 Sharing of Garage Operator Information
TL;DR: We share limited garage details with Users so they can book you, share payout details with Stripe to pay you, and share information with service providers who help us run the Service.
- With Users we share limited garage information (such as garage name, location, availability, and pricing) which is displayed to the Users so they can find and book your garage.
- With Stripe we share the payout and related information to enable them to process and remit payments to you. Stripe’s use of your information is governed by Stripe’s own privacy policy.
- In addition, we may share your information with service providers who help us operate the Service, including but not limited to hosting, analytics, and customer support tools, as well as in the other circumstances described in Part C of this Privacy Policy.
PART B: USERS / DRIVERS
B-1 Information We Collect from Users
TL;DR: We collect your contact details, payment info (processed by Stripe, not stored by us), reservation history, optional location data, and standard usage data; the categories we need to run the Service for you.
- Contact and identity information which includes but is not limited to name, phone number, and email address.
- Payment information which includes but is not limited to your card or payment details are collected and processed directly by our third-party payment processor, Stripe. CPS does not itself store your full payment card details.
- Reservation information which includes but is not limited to the garage(s) you book, reservation dates and times, and related booking history.
- Location data which includes but is not limited to if you enable location services, we may use your device’s location to help you find nearby available garages (“Location Data”). You can enable or disable this at any time through your device settings.
- Usage Data and Cookies, as described in Part C.
- We collect the categories of information described in this Section B-1 to provide the Service to you effectively. Further detail on how each category of information is used is set out in Section B-2 (How We Use User Information) below.
B-2 How We Use User Information
TL;DR: We use your information to run your account and bookings, process your payments and send receipts, communicate with you, help you find nearby parking, detect fraud or non-payment and improve the Service.
- To create and administer your CPS account and enable you to search for, book, and pay for Advance Reservations: using your contact and identity information and reservation information.
- To process your payments through Stripe and provide you with booking confirmations and receipts: using your payment information and reservation information.
- To communicate with you about your bookings, account, or customer support requests: using your contact and identity information and reservation information.
- To help you locate nearby available parking, where location services are enabled: using your Location Data.
- To detect, prevent, and investigate fraud, non-payment, or misuse of the Service: using your payment information and reservation information.
- To improve and analyze the Service: using Usage Data and Cookies.
B-3 Sharing of User Information
TL;DR: We share limited booking details with the Garage Operator you're booking with, share payment info with Stripe to process your payment, and share information with service providers who help us run the Service.
- With the Garage Operator you book with, we share limited information which includes your name and reservation details that is shared with the relevant Garage Operator to confirm and honor your booking.
- With Stripe we share your payment information to process your payment. Stripe’s use of your information is governed by Stripe’s own privacy policy, available at stripe.com/privacy.
- In addition, we may share your information with service providers who help us operate the Service, including but not limited to hosting, analytics, and customer support tools, as well as in the other circumstances described in Part C of this Privacy Policy.
PART C: GENERAL PROVISIONS (APPLICABLE TO GARAGE OPERATORS AND USERS)
TL;DR: This part applies to both Garage Operators and Users. It covers our use of cookies, Stripe as our payment processor, how long we keep your data, our security practices (including trial-stage limitations), your rights to access/correct/delete your data, your privacy rights under California, Connecticut, and other state laws, when we may disclose your information for legal or business reasons and how to reach us with questions.
C-1 Cookies and Tracking Technologies
- We use cookies and similar tracking technologies on the Website and App to operate the Service, remember your preferences, and analyze usage. These may include session cookies, preference cookies and security cookies.
- You can instruct your browser to refuse cookies, though some parts of the Service may not function properly without them.
C-2 Payment Processing (Stripe)
- We use Stripe, a third-party payment processor, to handle payment transactions on the Service. We do not store full payment card details on our own systems. Stripe’s collection and use of your information is governed by Stripe’s privacy policy, available at stripe.com/privacy.
C-3 Data Retention
- We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, to comply with our legal obligations, resolve disputes and enforce our agreements.
- Usage Data is generally retained for a shorter period, except where needed for security, fraud prevention, or legal compliance.
C-4 Security of Data
- We use commercially reasonable measures to protect personal information, but no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.
- As noted in our other Agreement/Terms and Conditions, our platform is in a trial/early stage and does not currently implement specialized or enhanced security measures beyond these standard practices, which we maintain as per applicable legal and standardized industry practices. Consistent with the data minimization principle recognized under applicable privacy laws, please avoid submitting information beyond what is reasonably necessary to use the Service.
C-5 Your Rights and Choices
- You may request to access, correct, update, or delete the personal information we hold about you by contacting us using the details in Section C-10 below.
- You may update certain account information directly within the App or Website account settings, where available.
- We may need to retain certain information where we have a legal obligation or legitimate business need to do so (for example, transaction records for tax or dispute purposes).
C-6 California Privacy Rights
- If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA) and the California Online Privacy Protection Act (CalOPPA), including the right to know what personal information we collect, to request deletion of that information, and to opt out of the sale or sharing of personal information. We do not sell personal information for monetary consideration.

C-7 Delaware Privacy Rights
- Delaware residents may have rights under the Delaware Personal Data Privacy Act (DPDPA), including the right to confirm whether we are processing your personal data, to access, correct, or delete that data, to obtain a portable copy of it, to obtain a list of categories of third parties to whom your personal data has been disclosed, and to opt out of certain processing such as targeted advertising, the sale of personal data, or profiling that produces legal or similarly significant effects. These rights apply to the extent the DPDPA applies to our processing activities.

C-8 Other State Privacy Rights
- If you are a resident of a U.S. state other than California or Delaware that has enacted its own comprehensive data privacy law (including but not limited to Virginia, Colorado, Utah, and other states with similar statutes now or hereafter in effect), you may have rights under that state’s law substantially similar to those described in Sections C-6 and C-7 above, such as the right to access, correct, delete or obtain a portable copy of your personal information and to opt out of certain processing including targeted advertising, sale of personal information or profiling. These rights apply to the extent the applicable state law covers our processing activities. To exercise any such rights, please contact us using the details in Section C-10 below.
C-9 Business Transactions and Legal Disclosures
- If CPS is involved in a merger, acquisition or asset sale, personal information may be transferred as part of that transaction and we will provide notice before it becomes subject to a different privacy policy.
- We may disclose personal information where required by law, in response to valid legal process or where we believe in good faith it is necessary to protect the rights, property or safety of CPS, our users, or the public.
C-10 Miscellaneous
- Your information may be processed and stored in the United States, which may differ from the data protection laws of your jurisdiction. By using the Service, you consent to this transfer.
- The Service is not directed to and we do not knowingly collect personal information from anyone under the age of 18. If we learn we have collected personal information from someone under 18 without appropriate consent, we will take steps to delete it.
- The TL;DR summaries and section/part titles used throughout this Privacy Policy are provided solely for ease of reference and general understanding, and do not form part of, or modify, this Privacy Policy. In the event of any conflict or inconsistency between a TL;DR summary or title and the terms of the corresponding Section or clause, the terms of the Section or clause shall supersede and govern.
